1. About These Terms
Welcome to Oz Camp Adventure Gear.
This website is operated by Gavin Tuo, a sole trader trading as Oz Camp Adventure Gear (ABN: 89 832 880 397).
In these Terms, “we”, “us” and “our” refer to Oz Camp Adventure Gear.
These Terms govern your use of our website and purchases made through our online store. By placing an order, you agree to these Terms and the applicable:
Shipping and Delivery Policy
Returns and Refunds Policy
Two-Year Product Warranty
Privacy Policy
Nothing in these Terms excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law (ACL) or other applicable laws that cannot lawfully be excluded.
2. Website Use
You must use our website lawfully and must not:
Interfere with the security or operation of the website
Upload malicious software or harmful code
Attempt unauthorised access to our systems or accounts
Misuse customer information
Reproduce or distribute our content commercially without permission
We may reasonably restrict or suspend access to our website where necessary to protect our website, customers or business, or to respond to a breach of these Terms.
3. Product Information and Suitability
We make reasonable efforts to keep product descriptions, specifications, photographs, prices and availability accurate.
Photographs may show optional accessories or equipment that are not included with the product. Product inclusions are those specifically stated in the relevant product listing.
Please note:
Colours may vary slightly between different screens and devices.
Product measurements and weights may be subject to reasonable manufacturing tolerances.
Product specifications may change where required by manufacturing or supply considerations.
We will communicate material changes where required by law.
Customers should check product suitability before purchasing, particularly for rooftop tents, awnings and vehicle-mounted equipment.
This includes checking:
Vehicle roof-load ratings
Roof-rack capacity
Mounting compatibility
Product dimensions and weight
Applicable manufacturer requirements
Installation instructions
If you are unsure whether a product is suitable for your vehicle or setup, please contact us before purchasing.
Nothing in this section limits our obligations to supply goods that match their description, are of acceptable quality or are reasonably fit for a purpose made known to us.
4. Prices and Payment
All prices are in Australian dollars (AUD) and include GST where applicable, unless otherwise stated.
Delivery, installation and other applicable charges will be shown before checkout or confirmed in a written quotation.
Price changes do not affect accepted orders except where permitted by law or otherwise agreed with you.
Payment must be made using one of the payment methods available at checkout.
Orders may be subject to reasonable payment verification and fraud-prevention checks.
5. Payment Methods
We accept the payment methods displayed at checkout. Available payment options may change from time to time.
Where third-party payment services or buy-now-pay-later services are offered, their use is subject to the provider’s eligibility requirements, approval process and terms.
Any applicable fees and repayment obligations will be disclosed by the relevant provider or at checkout as required by law.
Returns and refunds remain subject to our Returns and Refunds Policy and Australian Consumer Law.
Approved refunds will generally be processed through the original payment method or relevant payment provider.
6. Orders and Acceptance
An order acknowledgement does not necessarily mean that your order has been accepted.
We may need to verify order details, confirm freight arrangements or resolve an issue before accepting an order.
An order is accepted when we confirm acceptance or dispatch the goods.
We may decline or cancel an order for a genuine reason, including:
Stock being unavailable
An obvious pricing error
Suspected fraud or unauthorised payment activity
Inability to deliver to the nominated location
A breach of these Terms
If we cancel an order after receiving payment, we will refund the amount paid for the cancelled goods, including applicable delivery charges, unless another arrangement has been agreed with you.
We will not cancel an accepted order merely because the price of a product subsequently increases.
7. Stock Availability and Pre-Orders
If an item becomes unavailable after you place an order, we will contact you to discuss an alternative product, revised timeframe or refund.
Pre-order listings will state an estimated availability or dispatch timeframe where reasonably possible.
Pre-order dates may change due to circumstances including:
Manufacturing delays
Customs or import delays
Freight disruptions
Supplier availability
We will communicate significant delays and provide any options or remedies required by law.
We will not retain payment indefinitely where goods cannot be supplied within an agreed or otherwise reasonable timeframe.
8. Shipping and Delivery
We deliver to eligible Australian locations.
Available delivery and collection options, charges and restrictions will be provided at checkout or by written quotation.
Large products may only be available for:
Freight depot collection
Suitable commercial address delivery
Residential delivery by separate quotation, where available
Commercial delivery addresses must have suitable access and unloading facilities.
Delivery estimates are not guaranteed dates unless a specific delivery date has been expressly agreed.
For further information, please refer to our Shipping and Delivery Policy.
9. Freight Collection and Heavy Goods
Customers collecting large or heavy products are responsible for arranging:
A suitable vehicle
Appropriate load restraint
Sufficient loading assistance
Suitable loading equipment where required
Customers must comply with applicable road rules and vehicle load limits.
We may decline to provide loading assistance where the proposed loading method appears unsafe.
Installation or assembly at our warehouse or collection premises is not included unless expressly agreed in writing.
These requirements do not limit your statutory rights relating to damaged goods, defective products or other consumer guarantee claims.
10. Risk and Ownership
Ownership of goods passes to you once payment has been received in full, subject to applicable law.
Risk passes in accordance with Australian Consumer Law and other applicable laws.
Where we arrange delivery, we remain responsible for our obligations relating to those delivery arrangements.
We recommend inspecting your goods as soon as reasonably practicable after receiving them and notifying us of any apparent damage, missing items or discrepancies.
Delayed notification does not remove or limit your statutory rights.
11. Returns, Refunds and Consumer Guarantees
Our Returns and Refunds Policy explains our voluntary change-of-mind return conditions and statutory consumer remedies.
Our goods come with guarantees that cannot be excluded under Australian Consumer Law.
For a major failure, you may be entitled to reject the goods and choose a refund or replacement, subject to applicable law.
For a minor failure, we may be entitled to provide an appropriate remedy within a reasonable time.
You may also be entitled to compensation for reasonably foreseeable loss or damage.
Our change-of-mind return conditions do not restrict or replace your statutory rights.
12. Product Warranties
Our rooftop tents and awnings include a two-year express warranty against manufacturing defects, subject to the separate Two-Year Product Warranty.
Express warranty rights are additional to your statutory consumer guarantees.
Misuse, incorrect installation or unauthorised modifications may be excluded from the express warranty where they cause or contribute to a failure.
However, unrelated manufacturing defects and statutory consumer rights are not automatically excluded.
13. Installation and Safe Use
Products must be installed and used according to the supplied instructions and applicable requirements from vehicle, roof-rack and accessory manufacturers.
Before installation, customers should confirm:
Vehicle roof-load ratings
Roof-rack capacity
Mounting compatibility
Applicable product load limits
Manufacturer installation requirements
Professional installation is recommended if you are unsure about installation or compatibility.
Customers should inspect mounting hardware regularly and must not use equipment in unsafe weather conditions or contrary to supplied safety instructions.
To the extent permitted by law, we are not responsible for damage caused solely by incorrect installation, misuse or unauthorised modification.
This does not exclude liability for our own breach of law, negligence or consumer guarantee failures where that liability cannot lawfully be excluded.
14. Website Information and Availability
We aim to provide accurate information and reliable website operation. However, technical interruptions, errors or temporary unavailability may occur.
We may correct errors and update website content from time to time.
If an error materially affects an accepted order, we will contact you and resolve the matter in accordance with applicable law.
We do not guarantee uninterrupted website availability, without limiting any rights that cannot lawfully be excluded.
15. Third-Party Services and Links
Our website may contain links to third-party websites or use independent payment, freight, technology and other service providers.
Third-party services may operate under their own terms and privacy policies.
We are not responsible for independent third-party content or practices that are outside our reasonable control.
This does not remove or limit our statutory responsibilities for services we engage to fulfil an order.
16. Intellectual Property
Our original branding, logos, photographs, graphics, product content and written materials are protected by applicable intellectual property laws.
You may use our website for personal, non-commercial purposes.
You must not commercially reproduce, copy, modify, distribute or republish our content without permission, except where permitted by law.
17. Customer Reviews and Submissions
If you submit a review, photograph, comment or other content to us, you confirm that:
You have the right to provide the content.
The content is lawful.
The content does not infringe another person’s rights.
You grant us a non-exclusive, royalty-free licence to use and display submitted content for business and marketing purposes, unless otherwise agreed.
You retain ownership of your submitted content.
We may moderate or remove content that is unlawful, misleading, abusive or infringes the rights of others.
Personal information contained in submitted content is handled in accordance with our Privacy Policy.
18. Privacy and Security
We handle personal information in accordance with our Privacy Policy and applicable privacy laws.
Payments are processed through the payment services available at checkout.
We take reasonable steps to protect information and maintain website security. However, no online system can be guaranteed to be completely secure.
Customers are responsible for keeping their account credentials confidential and should notify us if they suspect unauthorised access to their account.
19. Limitation of Liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies that cannot lawfully be excluded.
To the extent permitted by law, we are not liable for losses caused by circumstances outside our reasonable control or damage caused solely by customer misuse, incorrect installation or unauthorised modification.
Any limitation of liability applies only to the extent that it is fair, reasonable and legally enforceable.
Nothing in these Terms excludes liability for our own negligence, breach of contract or statutory obligations where such exclusion would be unlawful.
20. Indemnity
You agree to indemnify us against reasonable losses, claims or expenses arising directly from your unlawful use of our website or material breach of these Terms, to the extent those losses, claims or expenses are caused by your conduct.
This indemnity does not apply to losses caused by our negligence, breach of law or failure to meet our obligations.
Nothing in this section limits your statutory rights.
21. Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, products, services or legal requirements.
Updated Terms will be published on our website with a revised Last updated date.
Changes will not retrospectively remove rights or materially alter accepted orders unless required by law or agreed with you.
22. Governing Law and Disputes
These Terms are governed by the laws of Victoria and applicable Commonwealth laws of Australia.
If you have a concern or dispute, please contact us first so we can attempt to resolve the matter fairly.
Nothing in these Terms prevents you from contacting a relevant consumer protection agency or bringing a claim before a court or tribunal with appropriate jurisdiction.
23. General Provisions
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Our failure to enforce a provision on one occasion does not constitute a waiver of our right to enforce that provision in the future.
These Terms, together with our applicable policies and any specific terms agreed at the time of purchase, form the agreement between you and Oz Camp Adventure Gear.
Nothing in this section excludes or limits statutory rights or obligations that cannot lawfully be excluded.
